Refund Policy

REFUND POLICY:

1. General position

1.1 This Refund Policy explains when Lunar Luxe Pty Ltd (ABN 82 613 965 629), operating under the business names The Max Effect Consulting and The Max Effect (we, us or our), will provide a refund.

1.2 This Refund Policy applies together with:

(a) our Customer Terms and Conditions;

(b) the applicable Offer Record;

(c) our Privacy Policy;

(d) our Disclaimer; and

(e) any applicable proposal, order form, statement of work or other written agreement.

1.3 Nothing in this Refund Policy excludes, restricts or modifies a consumer guarantee, right, remedy, warranty, condition or other legal protection that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law.

1.4 In this Refund Policy:

(a) Offer Record means the offer-specific information shown or provided to you at or before purchase, including an applicable sales page, checkout page, order confirmation, pricing page, proposal, invoice, order form, statement of work or other written offer details;

(b) Eligible One-Off Purchase means a one-off product or service for which the applicable Offer Record expressly states that the 30-Day Money-Back Guarantee applies;

(c) Subscription means a product or service that renews periodically until cancelled; and

(d) Third-Party Charges means usage, telecommunications, artificial intelligence, payment, platform or other charges imposed or incurred through a third-party provider.

2. 30-Day Money-Back Guarantee

2.1 The 30-Day Money-Back Guarantee is a voluntary change-of-mind guarantee.

2.2 It applies only to an Eligible One-Off Purchase where the applicable Offer Record expressly states that the guarantee applies.

2.3 It does not apply to every one-off product or service automatically.

2.4 It does not apply to a Subscription unless the applicable Offer Record expressly states otherwise.

2.5 You may request a refund of an Eligible One-Off Purchase for any reason by emailing [email protected] within 30 days after purchase.

2.6 Your request must identify:

(a) your name;

(b) the order or purchase; and

(c) each Eligible One-Off Purchase for which you are requesting a refund.

2.7 You do not need to prove that we were at fault or provide a reason for a change-of-mind request.

2.8 We may ask for an optional explanation to help us improve the product or service, but your request is not dependent on providing an explanation.

2.9 Each Eligible One-Off Purchase is treated separately.

2.10 If you purchased more than one eligible one-off product, you may request a refund for one or more of them.

2.11 Unless the Offer Record expressly states otherwise, the guarantee covers the purchase price actually paid for the relevant Eligible One-Off Purchase.

2.12 The 30-Day Money-Back Guarantee does not refund:

(a) a Subscription;

(b) email, SMS, telephone, artificial intelligence or other usage charges;

(c) Third-Party Charges;

(d) another product or service that was not identified as covered by the guarantee; or

(e) charges incurred after you activated or used separately billed functionality.

2.13 We will process an eligible refund to the original payment method where possible within 10 business days after confirming the purchase and eligibility.

2.14 Your bank or payment provider may take additional time to display the funds.

3. Effect of refunding a one-off purchase

3.1 When an Eligible One-Off Purchase is refunded:

(a) your licence and right to access and use the refunded product end;

(b) you must stop using and, where applicable, delete copies of the refunded product;

(c) we may remove, deactivate or disable the refunded system or product where technically practicable; and

(d) you remain responsible for usage and Third-Party Charges already incurred.

3.2 Refunding one product does not automatically end access to a separate product or service that:

(a) has not been refunded;

(b) remains active; and

(c) is not technically dependent on the refunded product.

4. Consumer guarantees and defective products or services

4.1 The 30-Day Money-Back Guarantee is additional to and does not limit your rights under the Australian Consumer Law or other applicable law.

4.2 After the 30-day period ends, we do not provide a refund merely because you:

(a) changed your mind;

(b) no longer require the product or service;

(c) found another product or service;

(d) did not use the product or service; or

(e) did not achieve a particular business result.

4.3 If a product or service does not comply with a consumer guarantee or another mandatory legal requirement, we will provide the remedy required by law.

4.4 Depending on the circumstances, the remedy may include:

(a) correcting a problem;

(b) providing the service again;

(c) replacing the product;

(d) reducing the price;

(e) cancelling the affected service; or

(f) providing a partial or full refund.

4.5 We may reasonably assess the product or service and request information needed to determine:

(a) what occurred;

(b) whether the problem can be corrected;

(c) whether the problem was caused by our work, your actions or a third party; and

(d) the appropriate remedy.

4.6 Your rights under applicable law may continue after the voluntary 30-day period has ended.

5. Third-party interruptions and changes

5.1 Some products and services depend on third-party platforms, software, hosting, telecommunications services, artificial intelligence providers, integrations and APIs.

5.2 A temporary outage, delay, interruption, approval delay or functionality change caused by a third party or event outside our reasonable control does not, by itself, create a right to a change-of-mind refund after the 30-day period.

5.3 Where reasonably practicable, we will use reasonable efforts to:

(a) investigate a reported problem;

(b) restore affected functionality that is within our control; or

(c) identify an available workaround.

5.4 Nothing in this clause:

(a) excludes responsibility for our own breach, negligence or wilful misconduct;

(b) limits an obligation expressly accepted in the applicable Offer Record; or

(c) limits a right or remedy that cannot lawfully be excluded.

6. Subscription cancellation and refunds

6.1 A Subscription renews at the price and frequency stated in the applicable Offer Record until cancelled.

6.2 You may cancel:

(a) through the cancellation facility made available in the platform; or

(b) if that facility is unavailable or you cannot access your account, by emailing [email protected].

6.3 A valid cancellation request received before the next renewal is processed will prevent the next Subscription renewal.

6.4 Cancellation otherwise takes effect at the end of the current paid billing period.

6.5 You may continue using the Subscription until the end of the current paid billing period, subject to the Customer Terms and Conditions.

6.6 We do not refund an unused portion of a paid billing period or reverse a properly processed renewal merely because the Subscription was not used or was cancelled after renewal, unless:

(a) the Offer Record states otherwise;

(b) we charged you after receiving a valid cancellation request before renewal; or

(c) a refund or other remedy is required by law.

6.7 The 30-Day Money-Back Guarantee for an Eligible One-Off Purchase does not apply to a Subscription unless its Offer Record expressly states otherwise.

6.8 Cancelling a Subscription does not automatically end a separate one-off product or other service that remains active.

7. How to make a request

7.1 Email [email protected] with:

(a) your name;

(b) your business name, if applicable;

(c) your order details;

(d) the product or service concerned;

(e) whether you are making:

(i) a 30-day change-of-mind request;

(ii) a request concerning a product or service problem; or

(iii) a Subscription cancellation request; and

(f) information reasonably needed to locate and verify the purchase.

7.2 For a request concerning a product or service problem, we may ask for information reasonably needed to investigate the issue and determine the appropriate remedy.

7.3 We will not require you to provide unnecessary personal information.

8. If a voluntary refund is declined

8.1 If we decline a voluntary refund request, we will explain:

(a) why the purchase was not eligible; and

(b) the information relied on.

8.2 You may provide further relevant information or ask us to review the decision.

8.3 This process does not remove or limit any right you have under applicable law.
